SGP-motie VVD en CDA steunden een motie van SGP, BBB en JA21 die vraagt of er strengere eisen kunnen worden gesteld aan organisaties die de staat voor de rechter slepen.

Johan Vollenbroek voelt zich niet bedreigd. Hij moet eigenlijk vooral lachen om de op dinsdag aangenomen motie waarin het kabinet wordt gevraagd om te onderzoeken of er strengere eisen kunnen worden gesteld aan belangenorganisaties die de staat voor de rechter willen slepen. ,,Maar het geeft vooral een dieptriest gevoel dat een Kamermeerderheid erin mee gaat."

De voorzitter van Mobilisation for the Environment (Mob) spant rechtszaken tegen de overheid aan over stikstof, met succes. Zo werd Mob in 2019 in verschillende procedures door de Afdeling bestuursrechtspraak van de Raad van State in het gelijk gesteld, waardoor duizenden vergunningen die waren verleend op grond van het Programma Aanpak Stikstof in de prullenbak konden. De stikstofcrisis was geboren. Dinsdag stemde de Tweede Kamer voor een motie die tijdens het klimaatdebat door SGP-Kamerlid Chris Stoffer was ingediend, met steun van BBB en JA21. Coalitiepartijen VVD en CDA stemden voor, tot ontsteltenis van coalitiegenoot D66.

Die vindt het ,,onbegrijpelijk en zorgelijk" dat coalitiegenoten instemmen met een voorstel dat de ,,toegang tot de rechter voor organisaties" lijkt te willen inperken, schrijft Kamerlid Joost Sneller op Twitter. De motie verzoekt het kabinet expliciet om te laten verkennen of strengere eisen kunnen worden gesteld aan de ontvankelijkheid van ,,belangenorganisaties met een ideëel doel". 'Verkiezingsretoriek' Omdat de motie tijdens het klimaatdebat werd ingediend, ligt het voor de hand dat de indieners van de motie hun inspiratie hebben gehaald uit klimaat- en milieu-uitspraken, ontlokt door procederende organisaties als Mob en Urgenda. In de motie wordt specifiek artikel 3:305a van het Burgerlijk Wetboek genoemd. Vollenbroek: ,,Dat heeft volgens mij met het vermogensrecht te maken en niks met het bestuursrecht.

Hij doelt op het Verdrag van Aarhus (1998), dat onder andere de toegang van burgers en organisaties tot de rechter over milieuzaken regelt. ,,

Daarin is overwogen dat ,,een milieuorganisatie ter bescherming van het milieu, zonder dat een aanwijsbare groep van personen bescherming behoeft" de overheid wel degelijk voor de rechter kan slepen. Het hof en de Hoge Raad gingen mee in deze interpretatie.

De mond snoeren ,,Wat me vooral aan de Urgenda-uitspraak triggerde was dat kolencentrales in Nederland dicht moesten, terwijl net over de grens in Duitsland veel viezere centrales staan", aldus Chris Stoffer, indiener van de motie. ,,Het algemeen belang is in mijn optiek de Nederlandse bevolking. In mijn ideaal komen alleen de Eerste en Tweede Kamer op voor het algemeen belang."

Hij begint over de Defensiewet. ,,Stel dat we daarin de 2 procentnorm [van de NAVO] vastleggen, en je komt in een bepaald jaar op 1,9 procent defensie-uitgaven uit. Gaan organisaties dan ook procederen? Dat moet je niet willen." ,,Het enige wat we doen is de regering aan wetten houden die ze zelf hebben bedacht. De overheid wordt toch geacht zich aan wetten te houden?", aldus milieuactivist Vollenbroek. Hij vindt het dan ook ,,moreel verwerpelijk dat de Kamer zegt dat ze geen ngo's willen die ons aan wetten houden die we zélf hebben goedgekeurd". Stoffer ontkent dat hij belangenorganisaties de mond wil snoeren. Hij hoopt dat het kabinet de motie niet naast zich neerlegt, en ,,een aantal scenario's gaat schetsen" die vervolgens in een Kamerdebat kunnen worden besproken. ,,Mijn punt is dat Urgenda op een heel strak doel zit. Als je daarmee komt, zou ik graag willen zien of je voldoende representatief bent."

Wanneer zou een organisatie dat zijn? ,,Je kan denken aan het hebben van heel veel betalende leden, of dat ze voor de belangen staan van een heel groot deel van de bevolking", zegt Stoffer. ,,Het liefst alle Nederlanders."
