By annexing Crimea, Vladimir Putin has violated texts from the United Nations (article 2§4 of the Charter), the statutes of the Council of Europe, 2 regional treaties (Charter of the Helsinki conference - 1975; Constituent Act of the Community of Independent States – 1991), two bilateral treaties signed with Ukraine and both the Constitution of Ukraine (article 73 and 132) and of the Autonomous Republic of Crimea (articles 2 and 6). Among the principles violated: inviolability of the States' territorial integrity, prohibition of the use of force, peaceful settlement of disputes, non-intervention in domestic affairs, peoples' right to self-determination. M. Putin also violated the Budapest Memorandum (1994), of which Russia is a party to, and which led to the denuclearisation of Ukraine in exchange for the specific guarantee of its borders. Today this guarantee no longer exists, which means Ukraine dropped a powerful weapon for a neighbour country that did not respect its part of commitments.

Yet, Russia intends to continue to transcend the law and continue towards its political goals (see the speech given by S. Lavrov, Russian Foreign Minister on 7th of February 2015 at the Munich Security Conference). This marks a break with traditional Russian diplomacy.

The consequences of theses breaches are the undermining of internal negotiations on nuclear (how to convince Iran to drop nuclear when Russia, as a member of the UN Security Council does not respect its engagement) but also the possible revival of demands made by minorities.

European response so far has been diplomatic (Minsk agreements), but the response cannot just be legal and political. Active diplomacy cannot just content itself with the law and cannot be undertaken without "hard power". Nevertheless, this must not weaken the founding belief that the law is the best instrument to settle relations between States and men.
